In recent years, the Court of Justice of the European Union and the European Court of Human Rights have decided an increasing number of cases that have raised issues concerning the impact of EU law or Article 6 of the ECHR on arbitration.

At this seminar, three leading experts will offer their perspectives on the current and potential impact of EU law and the right to a fair trial under article 6 of the ECHR on commercial arbitration.

The panel

  • Niels Fenger was appointed Professor of administrative law at the University of Copenhagen in 2009. In 2017, he was appointed High Court Judge, and in 2019, he became the Danish Parliamentary Ombudsman. He has been dealing extensively with EU law and its impact on national law.
  • Giuditta Cordero-Moss is a professor of private law at the University of Oslo. She represents the Norwegian government in UNCITRAL’s Working Group II, and she has published a large number of works on arbitration, private law, private international law and comparative law.
  • Clement Salung Petersen is a professor of civil procedure at the University of Copenhagen. His current research concerns, inter alia, the role of courts and state legal orders in alternative dispute resolution, including commercial arbitration.
